If you're really worried, just ask the author, but yes, technically, if the author's copyright states anything against recreation (which is usually doesn't) there is an issue. But just ask the author. Usually they don't care; fanart is so prevalent without any of this. You don't see a lot of manga fanart artists saying that this design was made by ......
