I think person B has to gtfo of that situation real fast, because if they accept A's sexual advances, not only A isn't the rapist, person B may even be accused as one. No you idiot. An intoxicated person cannot give consent under any circumstances. Person B can still be accused of rape regardless of if person A appeared to want it or not.   reply

When alcohol or drugs are involved, the legal determination of whether a person consented gets really dodgy. There have been cases where people have been raped after passing out and the rapists got off on charges. Rape is to this day still really hard to get any justice with. That is not consent. Person A can’t be intoxicated or under influence of anything (incl drugs) to give consent that won’t get Person B in trouble i.e. get charged with rape.   reply
