No. They weren't in any type of committed relationship not did they have any sort of agreement. Kagino was in a bad spot and he was trying to run away from his feelings, so he did what he was accustomed to (plus he was set up, so it got worse than it was supposed to be.) Now, that wasn't the healthiest way to cope and not everyone could and would accept this sort of things, so whatever Natsume thought of this and handled their relationship is kinda up to him.
