This was not rape in any way, form or shape. You don't ask someone to have sex with you. When the mood is right, it just happens (the only weird part was was that Tsumugu was right there...). Giving consent does not mean you have to say the words yes, you can also give consent through body language. If the character shown signs of being uncomfortable in that situation it can be called rape, but simply saying that he did not give consent because he did not say the words yes can be objective :)
