Looking at author's other work (payback) this definitely should be yaoi

If you read the novel, it's actually more intimate and sexual. Like they're so detailed about it that if they include it here it won't be tagged only as shounen ai.
Like the duke, we've seen him naked and obviously know he did the deed, but in the novel he's actually having sex while having the conversation. They just include the scene since the dialogue was important but the other sex scenes in the novel where there's no major dialogue, it was removed.

Its deffo yaoi not shounen ai regas has quite lot of sex scenes tbh.
