About tags: It is an ongoing story. If it has not happen in the story yet, it cannot be tagged.
If it does, in fact be Yaoi, they will add the tag yaoi. They can change or modify the tags.
I seen a story tagged shounen ai but changed to yaoi as the story progressed.
I have also since a yaoi tagged as shoujo. They changed it.
The tags are not good bases for an argument, especially with ongoing stories. At the moment it is not taged that but what if in chapter 45 he turns back and in chapter 46 it becomes a yaoi. The tags will be modified.
It have your argument with a better standing “ it's likely that he'll never be a guy again, and more likely stay as a girl for 1. Love and 2. Plot holes that'll never be explained.” I would say since he is still a girl in chapter 40, it seems unlikely he will change back with the amount of story already.
Or another argument could be if and when he becomes a male again, the story will end soon after that.
Please understand why tags are not support in cases like this.

First, fujoshi is a term that means rotten/dirty girl which is awful to be considered that for reading boy love story’s. The term Yaoi is actually negative. Terms Fudanshi, fujoshi, and Yaoi are stereotyping.
I would not consider you or anyone a full rotten/dirty girl.
Second, you miss out on other great stories and it would be hard to be a full fujoshi. That means no dc comics movies, marvel movies... wait I guess stories and books would be better, no dc comics or marvel comics, no horror stories, no detective stories, no other types of manga, Pokemon, Death Note, Black Butler.... etc.
You miss out of so much and limiting yourself. Please don’t do that to yourself.

Yaoi comes from "YAma nashi, Ochi nashi, Imi nashi", which means "no climax, no point, no meaning". What we call yaoi most do have a climax, has a point, and has meaning. Really if it did not have a point or meaning, it would not be poplar and people would not read it. The difference in between Bl and yaoi is sex scenes. And sex between two men has climax, a point, and meaning. Therefore, it is a negative Label. Kind of homophobic isn’t it? I have use yaoi because people will understand. I don’t want to explain if I used Bl and they corrected me to yaoi. Now I will.
I think I will stand up against these negative terms. We should not be viewed negatively for loving to read about love.
Only when people stand up does things change. It is about time for negative stereotyping to stop. It had nothing to do with other activities like playing sports. There are different kinds of sports and may plays different kinds. Michael Jordon has played basketball and golf plus others. Also, back to my aunt, she does have other activities besides reading, she makes quilts and crochets, makes crafts things, etc. So I was only focused on reading not other activities.
