Seriously? Do you tell a bullying victim to stop defending themselves just because they MIGHT kill the bully? So no what JOHN did wasn't murder. It was neither unlawful (self-defense is lawful in case you didn't know for some reason) nor was it premeditated by any stretch of the imagination.
