I read that differently. Even if it is in regards to what you actually meant about homophobia I believe. It almost sounded like the ones who made that statement were surprised that a gay man would touch his brother. And that they would be less surprised if a straight man touched his sister. But I sometimes interpret things weirdly so I sincerely hope you're taking that with a grain of salt.
Yes I acknowledge what I'm saying is gross and I apologize for that. . Still what I'm trying to convey is that this world may seem more equal in terms of sex/gender but there are definitely discrepancies in status and rape of women might not be taken as seriously. Rape of men might be considered more heinous. And given that this seems to be describing a long period before the current timeframe of the story there could have been even less equality. The author might be taking the setting of their story into account when mentioning that.
However, along with interpreting things weirdly I might just be coming up with excuses now. So my apologies again!
It's just as likely in real life that rape victims will not bring their rapists to trial as often as it is portrayed that they won't bring their rapists to trial in fiction. Precisely because the true meaning of consent (wholly affirmative and mutual agreements) is so obscured by outsiders.
As for your analogy though it kinda matches with the one I made in my previous post, in that sometimes one 'ism' can be used in place of another.
Homophobic? From your point of view, it maybe so and it is to a certain extent. But keeping in mind that homosexuality was not normalized in medieval times, it is something to be expected. And the "prince's brother who was famous for homosexuality did not hesitate to touch his brother" could mean the prince was famous and talked about a lot because of him liking the same gender, which was quite not normal and often frowned upon. And the author might be trying to create a tragic scenario of the jewelled eyes prince being raped by his gay brother when he couldn't resist or shield himself. Let's just hope it's actually this and the author is not homophobic
