If you make a move on someone incapable of making complete sentences due to being inebriated, then no, that’s assault. If you’re tipsy, that’s one thing, most people are still in control after only a few drinks. But in this case he trusts the guy, that’s why he said he felt safe to drink around him, he is NOT in a state of mind to consciously consent to ANYTHING that might be done to him.

I’m sorry, but you can consent when ur drunk, it’s a fact. There is a such think as drunken consensual sex, too. But speaking truthfully- both parties do not have to be drunk to have consensual sex. It’s only rape if the person is forcing sex upon you, or if u can’t do anything about it. Suyeong was able to speak “yeah...” “yeah... I do”, if he didn’t like where things were going, he could say no since he is CAPABLE of doing so. It is not against the law to have sex with a drunk person and the other to be sober, either. And I promise I’m not victim blaming! I just know that this isn’t rape. Hey, I truly don’t mean to offend anyone, and I’m definitely not trying to justify rape—I would NEVER do that. What I’m trying to do it’s clarify the situation, because many think this is rape when, indeed, it is not. In ch.20, while Suyeong is taking a shower, he has memories of his previous partner who was drunk and wanted sex, while Suyeong was sober. Suyeong clearly did not want sex, but the drunk partner wanted to force it. THAT is what I consider to be a form of rape. Both sides are consensual and know what they want. They are both adults and is aware of what sex is—if you know what is happening and is able to do something about it, ur in a consensual state. Hopefully that’s more understandable! U are still in a state of mind when drunk, that is why it is not illegal for one to be drunk and the other to be sober when having sex. It is definitely rape if one is unconscious, bc THAT aid not a consensual state. Being aware of what’s happening is the key—if ur in the mood and want it, then there ya go. It’s okay. No kissing or actual sex has happened in this chapter, so it’s only in the next chapter when we can officially know if this is rape or not. But so far, things are consensual.

Towards the end of the chapter you can clearly see Sooyoung beginning to fall asleep as he's near blackout drunk (confirmed that he blacked out in later chapters bc he doesn't remember anything) and yet Minhyuk is still making his move. You're right that there's no rape yet in THIS chapter, but next chapter Sooyoung is barely conscious and half asleep and therefore not sober/alert enough to give consent. What Minhyuk proceeds to do to him can be classified as sexual assault if not rape.

Oh I see ur point. I figured that there was nothing wrong, since he was conscious enough to answer questions. He said he liked him, which gave me the thought that- yeah, he’s interested. There’s a difference between drunk sex and this situation. Min-Hyuk even noted that he was able to easily push him over when he KNOWS how solid of a guy he is. The poor guy is TRASHED, and Min-Hyuk is taking advantage of that, and ANYTHING he does in this situation is assault, no question. He’s taking advantage of him, point blank, and Min-Hyuk himself is fucked up personality-wise. There’s been hints of it, and it becomes more obvious in the raw chapters, which you can find by Googling the Korean name.
