I don't think permission makes any difference. I would just say that he made sure that the other one wanted it.
The problem when somebody is drunk is that you never know if they are going to regret it later.
what you stated is literally the definition of permission.
and hoooo trust me they do not regret it later. they did act upon their interests towards each other after all. though I do agree, the kiss was done at a time of emotional vulnerability (?) and with an intoxicated party so if you view it from that angle it is certainly questionable.

I don't think it can be called permission under the influence of drugs. He wants it in that moment, but you can't be sure he really wants it.
