if the victim denies it there will be no case unless the victim is mentally unstable. but in both cases, the "rapist" will not go to jail. plus, the fact that the victim didnt try to prevent the rape with any physical power will be taken as an act of consent since the victim and the rapist had sex before and they were in some kind of relationship.
I don't think you remember the scene very clearly bud, Jinwoo just physically tried to kick him away, said no when he asked to enter, then said it hurts and to take it out when he ignored Jinwoo and went in, which is when Sangtae ignored him and said "if it hurts then-" before thrusting in all the way in one go. It's hard to argue with you when you're saying things that happened didn't happen. Also, they haven't "had sex", Sangtae has just been forcing himself on Jinwoo and Jinwoo has expressed displeasure each time.
