Yes the asshole brother is dead thankfully in the current timeliness. Right now it's talking about the past.

Why is he dead?

There isn't much information on why he is dead, but most likely it was either a. Intentional, b. Accidental or c. All of the Above or d. Something completely different.
My guess is that he's such an asshole and brought ML down so much that something happened in which caused his death. And as in the last chapter that has been released ML is planning to use Yeongwoon to get rid of him. Me and others are thinking through that plan ML fell in love with him. And then since asshole died, the family paid Yeongwoon's family in season 1 it showed, and that was a big thing of Yeongwoon's anxiety especially as he fell in love with ML, I don't know if I'm getting it all correct, but based on what I've read and known that's what it seems like. We will have to wait for future chapter to know why the asshole brother died lmao.

It suggested a few times that the brother has some sort of inflammatory illness, so my guess would be he died from that, or some accident. When brother realised that Seo-in liked Yeongwoo, he wanted to destroy Yeongwoo like he had done to all the other things Seo-in cherished in the past. On top of that, he already thoroughly disliked Yeongwoo because he lost to him in Judo and wanted to make him miserable too. Jaewon, the brother, then set Seo-in up to make it seem like he didn’t reciprocate Yeongwoo’s feelings. Im guessing that didn’t drive Yeongwoo away as well as Jaewon thought it would tho, with Yeongwoo being such a cinnamon roll, because Jaewon escalates and beats the shit out of him. Probably to stop Yeongwoo from going to the airport to see Seo-in off, since we see Seo-in waiting for him. Because one of her sons beat the shit out of Yeongwoo, the mother pays a settlement to hush the matter. However, I have a suspicion that the brother somehow pinned the bullying on Seo-in, since the news article Hae-Yool has says a top model was the culprit, and since the mother is so shocked to see Seo-in and Yeongwoo together. One of Yeongwoo’s friends also tells Seo-in that he has no right to see Yeongwoo, implying that the friend also thinks Seo-in was implicated in what Yeongwoo went through
