I think in this case the term dubious consent is the right one, Mc thoughts indicate confusion and it's his first time so he's scared and upset at the guy but it doesn't seem like a clear no, but it's not a yes either. The love interest should've asked more clear consent and he should be going slower but he did wait for the mc to sober up. Dubious consent is not good but it isn't rape

If it’s the real world then yes definitely rape. It’s still rape in this fictional world too but in BL it’s kinda been accepted as normal so most would say dubious consent. Even tho it’s rape it’s still ok to enjoy the story and the scene, it’s fiction so it’s fine. As long as we all know that in real life this is actually rape, so we aren’t confused by fiction.
