He was drugged the first time, and framed too. He didn't have a say or couldn't give consent. So even if it can be seen as "cheating" he didn't do it willingly. And remember, Benny cheated first and for a longer period of time, knowingly and willingly too. It was like he immediately began cheating when he MET Carter (I'm over exaggerating but he did start to develop feelings at first meeting).
