I know if *I* confessed to someone and they had passionate sex with me immediately after without saying anything to indicate it was a "no" and then also didn't tell me it was a "no" in the morning and that the sex was "just sex and not a response to the question you asked", *I'D* assume it was a "yes" and view that as cheating.
