Real rape is notoriously not taken seriously in most legal situations from both a media and legal standpoint. This is well documented and the reason for major movements to change that. I have no idea what you mean with "more strict with what is consensual".

Regardless, in the eyes of the law, being drunk does not invalidate your ability to give consent, regardless or your personal opinion.

I do agree I was wrong with the statement about age effecting someone’s argument, but i do stand by my other points. I would also like to point out in my state it is illegal to have sex with someone who is incapacitated. The reason why i felt it necessary to make my first comment is when incapacitated sex is in media and the ending is happy it leads to real life situations being romanticized. Imagine if a girl and a guy had sex and the girl tried to run away and since that doesn’t work she trys to avoid the man and he doesn’t know why. When the man sees her go into the club he follows her and doesn’t allow her to get with other men and takes her to his place since she’s drunk even though he has a number of a close friend of hers. At his place she’s so drunk she begs him to and sex with her, which the man complies. It looks as if the girl is giving consent but she is clearly incapacitated and not in her right mind, the man who isn’t drunk should be able to see that and reject her. This is how i see the situation between the two main leads and that’s why it feels so wrong to me, where a situation like this could be considered ok in real life.

This is an oddly specific scenario that is still not rape. I don't think you understand the legal definition of incapacitated because it doesn't fit here. Mental incapacity refers to the inability to make rational decisions due to mental illness or impairment, not intoxication. Intoxication is not a defense.
If you mean physically incapacitated, then obviously rape, but this is not what you've detailed in this scenario. What you have written here is morally ambiguous at best, but is 100 percent not rape in any state.

When a person is drunk they are not in the right mind and it isn’t possible for them to give consent. If this wasn’t the love interest and if they were “ugly” or smth you would say “get your hands off my baby”.
