If this is in real life, yes in some countries it is legally considered drunk sex = rape so if it happens to you and it bothers you (involved in a bad situation), you can scream rape and call the authorities or something. This is actually quite a pickle. Did you even read my 1-2 sentence? So you mean to say a person can bait people by going to bars, get drunk and let someone take them out, have drunken fun with them and then when youre sober -scream bloody rape on them?
What part of drunken mistake you dont understand? If the victim doesnt think of it as rape cause he did remember that he was the one who came onto him, then thats their personal business.
